Agreement to Terms

By accessing or using the MC Enterprises of South Florida website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our website or services.

Services Description

MC Enterprises of South Florida provides residential construction, remodeling, and design-build services in South Florida, principally Broward and Palm Beach counties. Services include but are not limited to kitchen remodeling, bathroom renovation, home additions, outdoor living spaces, and full home remodeling.

Specific services, timelines, costs, and deliverables will be outlined in individual project contracts and proposals. These Terms of Service govern your use of our website and our general service relationship.

Project Contracts and Proposals

All construction and remodeling projects require a separate written contract specifying scope of work, project timeline, payment schedule, materials, and other project-specific terms. The project contract supersedes these general Terms of Service for matters specifically addressed in the contract.

Where required by Section 713.015, Florida Statutes, your written contract will include the Construction Lien Law disclosure, and we will comply with the notice requirements of Chapter 713, Florida Statutes.

Estimates and Pricing

Estimates provided through our website, consultations, or proposals are approximate and subject to change based on actual project conditions, material costs, design changes, and unforeseen circumstances. Final pricing will be established in your project contract.

Free consultations and estimates are provided without obligation. However, detailed design work, engineering plans, or specialized assessments may incur fees as discussed prior to engagement.

Your Right to Cancel

If you sign a contract with us at your home or at any location other than our place of business, you may have the right to cancel that contract without penalty within three business days under Section 501.025, Florida Statutes. Any applicable cancellation rights and the method for exercising them will be stated in your written contract.

Licensing and Insurance

Licensing and insurance documentation for the work we perform is available upon request. Work requiring a licensed contractor is performed by appropriately licensed personnel in accordance with Chapter 489, Florida Statutes.

Client Responsibilities

When engaging our services, you agree to:

• Provide accurate and complete information about your property and project requirements
• Ensure we have reasonable access to the project site during agreed-upon working hours
• Make timely decisions on design selections, materials, and change orders
• Adhere to the payment schedule outlined in your project contract
• Obtain any required homeowner association (HOA) approvals prior to project commencement
• Inform us of any known property conditions that may affect the project

Permits and Regulations

We will obtain the necessary building permits for the contracted scope of work and perform that work in compliance with the Florida Building Code and applicable county and municipal requirements. Permit fees are typically included in the project proposal unless otherwise noted. The timeline for permit approval is determined by the local building department and is outside our direct control.

Warranties

We stand behind our workmanship. Specific warranty terms and coverage periods will be detailed in your project contract. Manufacturer warranties on materials and products are separate from our workmanship warranty and are governed by the respective manufacturer terms.

Limitation of Liability

To the maximum extent permitted by Florida law, MC Enterprises of South Florida shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim. Nothing in these Terms limits any liability that cannot lawfully be limited.

Intellectual Property

All content on our website, including text, images, graphics, logos, and design elements, is our property or used with permission and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our website content without written permission.

Custom designs, plans, and drawings created for your project remain our intellectual property until full payment is received, at which point design rights transfer to the client as specified in the project contract.

Website Use

You agree not to:

• Use our website for any unlawful purpose
• Submit false or misleading information through our forms
• Attempt to interfere with the proper functioning of our website
• Scrape, copy, or reproduce website content without permission
• Use automated systems to access our website in a manner that exceeds reasonable use

Dispute Resolution

Any disputes arising from these Terms of Service or our services shall first be addressed through good-faith negotiation. If negotiation is unsuccessful, disputes will be resolved through mediation or arbitration in Broward County, Florida, in accordance with Florida law.

Indemnification

You agree to indemnify and hold harmless MC Enterprises of South Florida, its officers, employees, and contractors from any claims, damages, or expenses arising from your use of our website or breach of these Terms of Service.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.

Governing Law and Venue

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The exclusive venue for any dispute shall be the state or federal courts located in Broward County, Florida.
